Unless explicitly stated otherwise:

A separate Privacy Policy governs data processing.

17. REGIONAL PROVISIONS

17.1 European Union

17.2 United States

17.3 United Kingdom

17.4 Canada

17.5 Australia and New Zealand

Our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law. For major failures with the service, you are entitled:

  • to cancel your service contract with us; and
  • to a refund for the unused portion, or to compensation for its reduced value.

You are also entitled to choose a refund or replacement for major failures with goods. If a failure with the goods or a service does not amount to a major failure, you are entitled to have the failure rectified in a reasonable time. If this is not done you are entitled to a refund for the goods and to cancel the contract for the service and obtain a refund of any unused portion. You are also entitled to be compensated for any other reasonably foreseeable loss or damage from a failure in the goods or service.

The notice above qualifies every warranty disclaimer and liability limitation in this Agreement and prevails over them. The guarantees attach to the Provider as supplier — Apple acts as the Provider’s agent in these territories, and on Google Play the Provider is the default seller. Section 64 ACL and s. 43 of the New Zealand Consumer Guarantees Act void any contracting-out.

18. SEVERABILITY

If any provision is invalid, the remainder remains in effect.

19. APPLE APP STORE — ADDITIONAL TERMS

This section applies only to copies of the App acquired through the Apple App Store. Where it conflicts with any other provision of this Agreement, this section prevails for those copies. It reflects the minimum terms Apple requires of a developer who supplies its own end user licence agreement.

19.1 Acknowledgement. This Agreement is concluded between you and the Publisher only, and not with Apple. The Publisher, not Apple, is solely responsible for the App and its content.

19.2 Scope of licence. The licence granted to you for the App is a non-transferable licence to use the App on any Apple-branded device that you own or control, and as permitted by the Usage Rules set out in the Apple Media Services Terms and Conditions, except that the App may be accessed and used by other accounts associated with you via Family Sharing or volume purchasing.

19.3 Maintenance and support. The Publisher is solely responsible for providing any maintenance and support services for the App. Apple has no obligation whatsoever to furnish any maintenance and support services in respect of the App.

19.4 Warranty. The Publisher is solely responsible for any product warranties, whether express or implied by law, to the extent they are not effectively disclaimed. In the event of any failure of the App to conform to an applicable warranty, you may notify Apple, and Apple will refund the purchase price for the App to you. To the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to the App. Any other claims, losses, liabilities, damages, costs or expenses attributable to a failure to conform to a warranty are the sole responsibility of the Publisher.

19.5 Product claims. The Publisher, not Apple, is responsible for addressing any claims relating to the App or your possession and use of it, including but not limited to product liability claims, any claim that the App fails to conform to any applicable legal or regulatory requirement, and claims arising under consumer protection, privacy or similar legislation, including in connection with the App’s use of any framework for the management of health or fitness data.

19.6 Intellectual property rights. In the event of any third-party claim that the App or your possession and use of it infringes that third party’s intellectual property rights, the Publisher, not Apple, is solely responsible for the investigation, defence, settlement and discharge of that claim.

19.7 Legal compliance. You represent and warrant that you are not located in a country that is subject to a US Government embargo or that has been designated by the US Government as a terrorist-supporting country, and that you are not listed on any US Government list of prohibited or restricted parties.

19.8 Developer name and address. Questions, complaints and claims relating to the App are directed to: DigitalFreedom Global LLC, 30 N Gould St, Ste N, Sheridan, WY 82801, United States · support@digitalfreedom.co.za · https://support.apps.digitalfreedom.co.za

19.9 Third-party terms. You must comply with applicable third-party terms of agreement when using the App.

19.10 Third-party beneficiary. You acknowledge and agree that Apple and Apple’s subsidiaries are third-party beneficiaries of this Agreement, and that upon your acceptance of it Apple will have the right — and will be deemed to have accepted the right — to enforce this Agreement against you as a third-party beneficiary of it.

20. GOOGLE PLAY — ADDITIONAL TERMS

This section applies only to copies of the App acquired through Google Play, and prevails over conflicting provisions for those copies.

20.1 This Agreement is concluded between you and the Publisher only, and not with Google. The Publisher is solely responsible for the App and its content.

20.2 Your use of the App must comply with the Google Play Terms of Service then in force.

20.3 Google is a provider of the distribution and, where applicable, billing services only. It bears no responsibility for the App, offers no warranty in respect of it, and is not a party to this Agreement.

20.4 Questions, complaints and claims relating to the App are directed to the Publisher at the address in § 19.8.

21. ENTIRE AGREEMENT

This Agreement constitutes the entire agreement between you and the Publisher.

It supplements the platform terms of the store the App was acquired from. Sections 19 and 20 above take precedence over any conflicting provision of this Agreement for copies acquired through the respective store.

BY USING THE APP, YOU AGREE TO THIS AGREEMENT.
